Jump to Cancellation & Weather PoliciesI. General Professional Standards & Operations (All Clients)
As used in this agreement, "Company," "we," "our," or "Contractor" refers to Mrs Sparkle Cleaning Co. "Client," "you," or "your" refers to the individual, homeowner, or corporate entity booking or authorizing our services.
- 1. The "Clutter-Free" Efficiency Standard: To ensure the highest level of efficiency and care, we ask that you prepare your space prior to our arrival so our technicians can focus entirely on cleaning surfaces. Surfaces & Floors: Please clear countertops, tables, desks, and floors of personal items, toys, and sensitive or loose paperwork. Sink Maintenance: Ensure kitchen and breakroom sinks are free of unwashed dishes. If you require dishwashing services, please add our specialized Dishes Package to your recurring booking. Secure Valuables: Clients must store jewelry, fragile heirlooms, cash, keys, and sensitive or proprietary documents in a secure, locked location prior to our arrival.
- 2. Access, Security, & Environment: Clear Entry: Ensure clear entry instructions (key, keypad code, alarm code, or the physical presence of a staff or household member) are provided ahead of your scheduled slot. Our team strives for absolute punctuality; please allow a 30-minute grace period to account for local St. Louis traffic conditions. Climate Control: For the safety, health, and operational productivity of our field technicians, facilities must maintain a comfortable indoor temperature during service. Right to Refuse Service: We reserve the immediate right to vacate any premises if our technicians encounter a hostile environment, unsafe structural conditions, or hazardous materials.
- 3. Health & Environmental Safety: Our teams utilize state-of-the-art, best-practice procedures and color-coded microfiber technology to eliminate cross-contamination and maintain uncompromised hygiene standards. Biohazards: Our technicians are strictly equipped and trained for standard sanitation only. They are not authorized to handle, clean, or remediate biohazardous materials, including heavy mold, black mold, severe pest infestations, or animal/human waste. We will clean surrounding safe zones and notify the Client immediately for specialized remediation. Safety Restrictions: For safety and liability reasons, our technicians do not climb ladders higher than a standard 3-step stool, move heavy furniture exceeding 35 pounds, or clean exterior windows.
- 4. Professional Supplies, Equipment & Special Requests: Mrs Sparkle Cleaning Co provides the professional cleaning agents, equipment, and color-coded microfiber towels ordinarily required to perform the agreed service. Reusable tools and supplies are cleaned and disinfected after each service to reduce cross-contamination. Clients must email info@mrssparklestl.com at least 24 hours before the scheduled service to identify a Do Not Disturb zone or request attention to an additional area. Additional requests remain subject to available service time, safety requirements, and confirmation by our office.
- 5. Service Agreement & Client-Specific Terms: The service address, approved scope, service frequency, scheduled rate, billing structure, and other client-specific arrangements stated in an accepted quote or signed service activation agreement are incorporated into these Terms. If a client-specific term in an accepted quote or signed agreement conflicts with these general Terms, the client-specific term controls only for that subject and client.
II. Residential-Specific Policies
- 1. Cancellation, Rescheduling & Residential Lockout Policy: We require at least 24 hours' notice to cancel or reschedule a service. Notice must be provided by calling or texting 314-723-2041 or emailing info@mrssparklestl.com. Notice is measured from the scheduled service start time. A cancellation or rescheduling request made with less than 24 hours' notice, or a lockout that prevents our team from accessing the property for a scheduled service, is an occurrence. Fees are $50 for the first occurrence, $100 for the second occurrence, and 100% of the scheduled service price for the third and each subsequent occurrence. Occurrences are counted per client account on a rolling 12-month basis; an occurrence no longer counts once it is more than 12 months old. Mrs Sparkle Cleaning Co may reduce or waive a fee at its discretion. A reduction or waiver is a one-time courtesy and does not change this policy or require a future reduction or waiver.
- 2. Inclement Weather: For the safety of our clients and team, Mrs Sparkle Cleaning Co follows the Lindbergh School District during inclement weather. If Lindbergh schools are closed for the full day due to weather, residential services are automatically suspended, no cancellation fee applies, and affected clients receive priority rescheduling. For delayed openings, early dismissals, or other changing weather conditions, we will work with the client to determine whether it is safe to perform the service. If Mrs Sparkle Cleaning Co suspends or reschedules a service because conditions are unsafe, no cancellation fee applies.
- 3. Travel Alternative: Traveling clients may ask us to perform a Deep Sparkle Reset while they are away instead of canceling a scheduled visit. Property access and service details must be arranged with our office in advance.
- 4. Pet Guidelines: For the safety and comfort of your animals and our team, please secure pets (cats, dogs, or other animals) in a crate, kennel, or separate designated room during service if they are prone to biting, territorial anxiety, or bolting out of open doors.
- 5. Residential Payment Terms: Due Timing: Payment for residential services is due in full at the time of service delivery. Accepted Methods: We accept ACH transfers, major credit/debit cards, Venmo, cash, or checks (payable to Mrs Sparkle Cleaning Co). Failed Payments: Declined credit cards or failed electronic payments will incur a $25 administrative fee if not resolved within 24 hours of notification. Returned checks will immediately incur a $35 Non-Sufficient Funds (NSF) fee. Outstanding balances will result in immediate service suspension.
III. Commercial-Specific Policies (B2B Accounts)
- 1. Independent Contractor Relationship: Mrs Sparkle Cleaning Co performs commercial services as an independent contractor and retains control over the cleaning methods, equipment configurations, and personnel used to complete the agreed scope. No employment, agency, partnership, or joint-venture relationship is created between the Client and Mrs Sparkle Cleaning Co or its technicians. Mrs Sparkle Cleaning Co remains responsible for the employment taxes, payroll withholding, and insurance obligations applicable to its personnel.
- 2. Commercial Payment & Credit Terms: Invoicing Cycle: Commercial accounts are invoiced weekly or monthly as specified in the accepted service schedule or activation agreement. Net Terms: Approved commercial accounts operate on a strict Net 15-day payment cycle from the invoice issuance date unless an alternative arrangement has been authorized in writing by our office. Accepted Methods: Commercial clients may pay by ACH transfer or e-check, an approved credit or debit card on file subject to applicable card-processing policies, or corporate check subject to Net 15 credit approval.
- 3. Late Payment Penalties & Collections: Interest Accrual: An invoice not paid by its Net 15 due date will accrue a late payment charge of 1.5% per month, or the maximum rate permitted by Missouri law if lower, on the outstanding balance beginning on the original due date. Service Suspension: Commercial accounts that reach thirty (30) days past due will face automatic service suspension. We accept no liability for facility conditions, tenant disputes, or lease violations resulting from a credit-related suspension of cleaning services. Collection & Legal Costs: If Mrs Sparkle Cleaning Co must initiate formal collection proceedings, retain a collection agency, or take legal action to recover a past-due commercial balance, the Client agrees to pay all reasonable and documented costs of collection, including collection fees, court costs, and reasonable attorney's fees.
- 4. Commercial Facility Cancellation & Lockout: Cancellation Notice: Commercial clients must provide at least 48 hours' notice to cancel or reschedule a recurring commercial cleaning. Notice must be provided by calling or texting 314-723-2041 or emailing info@mrssparklestl.com and is measured from the scheduled service start time. A cancellation or rescheduling request made with less than 48 hours' notice will be billed at 50% of the scheduled service rate. Facility Lockouts: If our technicians arrive during the scheduled service window and are denied access, turned away by on-site staff, or locked out because a key, fob, alarm code, or other access change was not communicated, the Client will be billed 100% of the scheduled service rate.
- 5. Authority to Bind Commercial Client: Any person who signs a commercial service activation agreement, accepts a commercial quote, or authorizes commercial service on behalf of a company or other legal entity represents that they have authority to bind that entity to the applicable service scope, financial obligations, and these Terms.
IV. Liability, Risk Management, & Intellectual Property
- 1. Property Care & Damage Caps: We treat every residential home and commercial facility with the utmost professional care. However, in the rare event of accidental damage or breakage, our liability is managed under the following terms: Valuation Cap: Our liability for accidental breakage or damage caused by our technicians is strictly limited to the direct repair cost or actual replacement value of the specific item. It is explicitly capped at a maximum of $5,000 per incident or the total cash value of services rendered over the previous 12 months, whichever is less. Irreplaceable Items: We ask that "irreplaceable" or highly sentimental items (e.g., unique artwork, high-value antiques, custom family heirlooms) be completely secured or marked as a "Do Not Disturb" zone prior to service. Pre-existing Conditions: Mrs Sparkle Cleaning Co is not liable for damages or structural failures caused by improper initial installation, manufacturing defects, or inherent wear-and-tear. This includes, but is not limited to, loose cabinet doors, improperly anchored pictures or mirrors, fragile window blinds, or unstable shelving units.
- 2. Mutual Indemnification (Commercial Framework): For all B2B and commercial property relationships, indemnification is structured mutually: Scope: Each party agrees to indemnify, defend, and hold harmless the other party from and against direct property damages, liabilities, or losses resulting solely from the direct gross negligence or willful misconduct of the indemnifying party’s employees or agents during the active timeline of this agreement. Contributory Risk Exclusion: Mrs Sparkle Cleaning Co shall not be held liable for third-party slip-and-fall claims or premises injuries if proper standard operating procedures—specifically the prominent placement of "Wet Floor" cautionary signage—were executed by our technicians on site during or immediately following cleaning cycles.
- 3. Intellectual Property & Operational Preservation: As a highly specialized service provider, Mrs Sparkle Cleaning Co has invested substantial capital and time into developing proprietary workflows, chemical formulation combinations, equipment configurations, quality-control metrics, and operational training guidelines. Ownership: All methodologies, custom checklists, and workflows utilized by our technicians while on a Client's residential or commercial property remain the exclusive intellectual property of Mrs Sparkle Cleaning Co. No Transfer: No transfer of intellectual property, proprietary methods, or "work-for-hire" status is executed under this service relationship. Clients are strictly prohibited from copying, distributing, or reverse-engineering our operational documents or cleaning systems for internal corporate use or competitive commercial deployment.
V. The Mrs Sparkle Cleaning Co Quality Guarantee
Our entire brand and reputation are built on uncompromised quality. If our team misses a specific area or fails to meet our professional standards, please notify our office via phone or email within 24 hours of service completion. Provided we are notified within this 24-hour window, our team will return to your home or facility at our earliest operational convenience to rectify the specified issue completely free of charge. Please note that refunds or invoice credits are not issued; our guarantee is fulfilled strictly through immediate operational correction.
VI. Governing Law & Severability
These Terms of Service, along with all operational interactions and formal service contracts, shall be governed by, interpreted, and enforced in accordance with the laws of the State of Missouri, without regard to its conflict of law principles. If any individual provision, paragraph, or clause of these Terms of Service is deemed invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect, and the court is authorized to modify the unenforceable provision to reflect the original intent of the parties as closely as possible.
